Terms of service

Updated: 18 September 2026

This is an English translation of the Czech Terms of Service. In case of any discrepancy, the Czech version prevails.

1. INTRODUCTORY PROVISIONS

1.1. Treasures Prague is operated by Tina Tobolová, with registered address at Holubova 844, Holice 534 01, Czech Republic, Company ID: 19554681 (hereinafter the "seller").

1.2. In accordance with Section 1751(1) of Act No. 89/2012 Coll., the Civil Code, as amended (hereinafter the "Civil Code"), these terms of service of the seller govern the mutual rights and obligations of the contracting parties arising in connection with or on the basis of a purchase contract (hereinafter the "purchase contract") concluded between the seller and another natural person (hereinafter the "buyer") through the seller's online store. The online store is operated by the seller on the website located at www.treasuresprague.com (hereinafter the "website"), through the website interface (hereinafter the "store web interface").

1.3. These terms of service do not apply where the person intending to purchase goods from the seller is a legal entity or a person acting in the course of their business or independent profession when ordering the goods.

1.4. Provisions deviating from these terms of service may be agreed in the purchase contract. Deviating provisions in the purchase contract take precedence over the provisions of these terms of service.

1.5. The provisions of these terms of service form an integral part of the purchase contract. The purchase contract and the terms of service are drawn up in the Czech language. The purchase contract may be concluded in the Czech language.

1.6. The seller may amend or supplement the wording of the terms of service. This provision does not affect rights and obligations arising during the effectiveness of the previous version of the terms of service.

2. VINTAGE, PRE-OWNED ITEMS, REPAIRS

2.1. With few exceptions, the seller offers only pre-owned and vintage goods. Unless stated otherwise, the seller sells a used, worn item. Used items show various wear, damage and imperfections (hereinafter "signs of use"). These signs of use result from previous use, storage and the age of the item and must be expected. The used items offered by the seller are generally not suitable for customers who prefer products with no or minimal signs of use.

2.2. The buyer acknowledges that the goods are offered at significantly reduced prices compared to similar new goods in boutiques. This price advantage reflects the existing signs of use, age, shortened lifespan, repairs carried out, the risk of further damage and the risk of further repairs being needed.

2.3. The buyer is obliged to thoroughly familiarise themselves with the condition of the goods on the basis of the photographs and description provided by the seller. It is not always possible to capture 100% of all individual signs of use in photographs. If the buyer is unsure about the condition, they may contact the seller before purchase to consult the condition.

2.4. The condition of the goods is graded with the letters A+ to C. This scale is adapted to the context of used goods.
Legend:
A+ Excellent – Used but with almost no signs of wear.
A Very good – Normal signs of wear such as minor scratches, scuffs, marks, wrinkles, wear to the hardware, wear to the corners, etc. to a lesser extent. Various repairs, dyeing, etc. may have been carried out.
B Good – More pronounced signs of wear such as scratches, scuffs, marks, wrinkles, wear to the hardware, wear to the corners, etc. to a greater extent, spots, dirt, rubbing, deterioration, discolouration, other wear of the material, etc.
C Fair – A higher degree of wear. May or may not be suitable for repair/restoration.
The assessment of the condition and its classification into one of the categories above (A+ to C) is only the subjective opinion of the seller, and the buyer acknowledges that this assessment may not correspond to the buyer's own assessment.

2.5. Unless stated otherwise, the goods offered may have been repaired, altered, restored, refreshed and modified in various ways. This may include, for example, corner repairs, replacement of a leather part, dyeing, filling with filler, zip repairs, stitching, etc. (non-exhaustive list).

2.6. If the buyer wishes to receive information about specific repairs, alterations, restorations, refreshes and modifications carried out, they may contact the seller.

2.7. The seller will always state in the description if the goods offered have been fitted with unbranded, non-original components (e.g. a new strap, chain or handle).

2.8. The buyer understands that some goods already arrive at the seller repaired by suppliers and, given the nature of the goods, such repairs cannot always be easily identified.

2.9. The seller is not the manufacturer of the goods. Given the nature of used goods (see Article 2), natural wear and the limited lifespan of the material, in particular leather, are not considered a defect of the goods; this does not affect the seller's liability for the goods being in conformity with the agreed description upon receipt by the buyer pursuant to Article 7 of these terms of service.

2.10. The goods offered are guaranteed 100% authentic. In the very unlikely event that the goods are later found not to be authentic, we guarantee a full refund at any time.

3. CONCLUSION OF THE PURCHASE CONTRACT

3.1. All presentation of goods on the store web interface is for information purposes only, and the seller is not obliged to conclude a purchase contract regarding such goods. Section 1732(2) of the Civil Code does not apply.

3.2. The store web interface contains photographs of the goods and information about the goods, including a description of their condition and the prices of individual items. Prices of goods are stated including value added tax and all related fees. Prices remain valid for as long as they are displayed on the store web interface. Prices are not personalised to the buyer on the basis of automated decision-making. This provision does not limit the seller's ability to conclude a purchase contract on individually agreed terms.

3.3. The store web interface also contains information on the costs of packaging and delivery of the goods and on the method and time of delivery. Information on packaging and delivery costs stated on the store web interface applies only where goods are delivered within the territory of the Czech Republic. Where the seller offers free shipping, the buyer's entitlement to free shipping is conditional on paying the minimum total purchase price of the goods shipped as stated on the store web interface. If the buyer partially withdraws from the purchase contract and the total purchase price of the goods for which the buyer has not withdrawn does not reach the minimum amount required for free shipping under the previous sentence, the buyer's entitlement to free shipping lapses and the buyer is obliged to pay the seller for the shipping.

3.4. To order goods, the buyer completes the order form on the store web interface. The order form contains in particular information about:
3.4.1. the goods ordered (the buyer "places" the ordered goods in the electronic shopping cart of the store web interface),
3.4.2. the method of payment of the purchase price and details of the requested method of delivery of the ordered goods, and
3.4.3. information on the costs of delivery of the goods (hereinafter jointly the "order").

3.5. Before sending the order to the seller, the buyer is able to check and change the data entered in the order, including the ability to identify and correct errors made when entering data. The buyer sends the order to the seller by clicking the "Pay" button. The data stated in the order are deemed correct by the seller. Immediately after receiving the order, the seller confirms its receipt to the buyer by e-mail to the buyer's e-mail address stated in the order (hereinafter the "buyer's e-mail address").

3.6. Depending on the nature of the order (quantity of goods, purchase price, expected shipping costs), the seller is always entitled to ask the buyer for additional confirmation of the order (for example in writing or by telephone).

3.7. The contractual relationship between the seller and the buyer is established upon delivery of the acceptance of the order, which the seller sends to the buyer by e-mail to the buyer's e-mail address.

3.8. The buyer agrees to the use of means of distance communication when concluding the purchase contract. Costs incurred by the buyer when using means of distance communication in connection with concluding the purchase contract (internet connection costs, telephone call costs) are borne by the buyer; these costs do not differ from the standard rate.

4. PRICE OF GOODS AND PAYMENT TERMS

4.1. The buyer pays the price of the goods and any delivery costs under the purchase contract by bank transfer to the seller's account no. 2537456015/3030 held with AirBank (hereinafter the "seller's bank account") using a QR code provided by the seller after clicking the "Pay" button.

4.2. Together with the purchase price, the buyer is obliged to pay the seller the agreed costs of packaging and delivery of the goods. Unless expressly stated otherwise, the purchase price also includes the delivery costs.

4.3. The order will be confirmed once the relevant amount has been credited to the seller's account. Until then, the goods remain available for purchase by other customers.

4.4. If the buyer's bank does not support instant payments, the buyer shall inform the seller. In that case, the seller will confirm the order once the buyer has sent the payment, even before it is credited to the seller's account.

4.5. The buyer's obligation to pay the purchase price is fulfilled at the moment the relevant amount is credited to the seller's account.

4.6. Any discounts on the price of goods provided by the seller to the buyer cannot be combined.

4.7. Where customary in business or required by generally binding legal regulations, the seller issues the buyer a tax document – invoice – for payments made under the purchase contract. The seller is a VAT payer. The seller issues the tax document – invoice – after the price of the goods has been paid and sends it electronically to the buyer's e-mail address.

5. WITHDRAWAL FROM THE PURCHASE CONTRACT

5.1. The buyer acknowledges that under Section 1837 of the Civil Code it is not possible, among other things, to withdraw from a purchase contract for the supply of:
5.1.1. goods made to the buyer's specifications or adapted to their personal needs,
5.1.2. perishable goods or goods with a short shelf life, as well as goods which, after delivery, have by their nature been irreversibly mixed with other goods,
5.1.3. goods in a sealed package which are not suitable for return for health protection or hygiene reasons once the buyer has broken the seal, and
5.1.4. audio or video recordings or computer software in a sealed package if the buyer has broken the seal.

5.2. Unless it is a case referred to in Article 5.1 or another case in which withdrawal from the purchase contract is not possible, the buyer has the right, in accordance with Section 1829(1) and (2) of the Civil Code, to withdraw from the purchase contract within fourteen (14) days of the day on which the buyer or a third party designated by the buyer (other than the carrier) takes over the goods, or:
5.2.1. the last item of goods, if the buyer orders several items within one order that are delivered separately,
5.2.2. the last item or part of a delivery of goods consisting of several items or parts, or
5.2.3. the first delivery of goods, if the contract provides for regular delivery of goods over an agreed period.

5.3. Notice of withdrawal from the purchase contract must be sent to the seller within the period stated in Article 5.2. To withdraw from the purchase contract, the buyer may use the model form available at https://coi.gov.cz/userdata/files/dokumenty-ke-stazeni/odstoupeni-od-smlouvy-formular.docx. The address for returning goods and withdrawing from the contract is: Tina Tobolová, Palác Ligna, Vodičkova 791, Prague 1, 110 00, Czech Republic.

5.4. Goods returned within the 14-day period must not have been used by the buyer and should be returned in the original packaging, including all gifts. Given the nature of the goods sold (used goods with various signs of wear), the intact tag attached by the seller, which must not have been removed, serves as a guarantee that the buyer has not used the goods further.

5.5. The seller is entitled to compensation for costs actually incurred in connection with the return of the goods if the packaging or goods are not in their original condition. These costs are assessed individually and may be set off against the amount for the returned goods. If the goods are not returned in their original condition, including packaging, tag and gifts, the buyer may be charged for the reduction in the value of the goods. In accordance with the law and the position of the Czech Trade Inspection Authority, the reduction in value may be up to 100%.

5.6. In the event of withdrawal from the purchase contract, the purchase contract is cancelled from the outset. The buyer shall send or hand over the goods to the seller without undue delay, at the latest within fourteen (14) days of withdrawing from the contract, unless the seller has offered to collect the goods. The period under the previous sentence is met if the buyer sends the goods before it expires. If the buyer withdraws from the purchase contract, the buyer bears the costs of returning the goods to the seller, even if the goods cannot be returned by regular post due to their nature.

5.7. In the event of withdrawal from the purchase contract under Article 5.2, the seller will refund the money received from the buyer within fourteen (14) days of the buyer's withdrawal, in the same way in which the seller received it. The seller is also entitled to refund the payment when the buyer returns the goods or in another way, if the buyer agrees and no additional costs arise for the buyer. If the buyer withdraws from the purchase contract, the seller is not obliged to refund the money received before the seller receives the goods or the buyer proves that the goods have been sent back, whichever occurs first.

5.8. The seller is entitled to unilaterally set off a claim for compensation for damage to the goods against the buyer's claim for a refund of the purchase price.

5.9. In cases where the buyer has the right to withdraw from the purchase contract under Section 1829(1) of the Civil Code, the seller is also entitled to withdraw from the purchase contract at any time until the buyer takes over the goods. In such a case, the seller will refund the purchase price to the buyer without undue delay by bank transfer to the account designated by the buyer.

5.10. If a gift is provided to the buyer together with the goods, the gift agreement between the seller and the buyer is concluded subject to a condition subsequent: if the buyer withdraws from the purchase contract, the gift agreement for that gift ceases to have effect and the buyer is obliged to return the gift to the seller together with the goods.

6. TRANSPORT AND DELIVERY OF GOODS

6.1. If the method of transport is agreed on the basis of a special request by the buyer, the buyer bears the risk and any additional costs associated with that method of transport.

6.2. If the seller is obliged under the purchase contract to deliver the goods to the place specified by the buyer in the order, the buyer is obliged to take over the goods upon delivery.

6.3. If, for reasons on the buyer's side, the goods need to be delivered repeatedly or in a manner other than that stated in the order, the buyer is obliged to pay the costs associated with the repeated delivery or with the other method of delivery.

6.4. When taking over the goods from the carrier, the buyer is obliged to check that the packaging is intact and to notify the carrier immediately of any defects. If the packaging shows signs of unauthorised entry into the parcel, the buyer does not have to accept the parcel from the carrier. This does not affect the buyer's rights arising from liability for defects of goods and other rights of the buyer under generally binding legal regulations.

6.5. Further rights and obligations of the parties during transport of the goods may be governed by the seller's special delivery terms, if issued by the seller.

7. RIGHTS ARISING FROM DEFECTIVE PERFORMANCE (COMPLAINTS)

7.1. The rights and obligations of the contracting parties regarding rights arising from defective performance are governed by the relevant generally binding legal regulations (in particular Sections 1914 to 1925, 2099 to 2117 and 2161 to 2174b of the Civil Code and Act No. 634/1992 Coll., on Consumer Protection, as amended).

7.2. Signs of use under Article 2.1 et seq. and repairs and modifications under Article 2.5 et seq. of these terms of service are not considered defects within the meaning of the Civil Code and rights arising from defective performance.

7.3. The seller is liable to the buyer for the item being free from defects upon takeover. In particular, the seller is liable to the buyer that the item:
7.3.1. corresponds to the agreed description, type and quantity,
7.3.2. is fit for the purpose for which it is usually used.

7.4. Article 7.3 does not apply if, before concluding the purchase contract, the seller specifically informed the buyer that a particular characteristic of the item differs and the buyer expressly agreed to this when concluding the purchase contract.

7.5. If the item has a defect, the buyer may demand its removal. At their choice, the buyer may demand delivery of a new item without defects or repair of the item, unless the chosen method of removing the defect is impossible or disproportionately expensive compared to the other; this is assessed in particular with regard to the significance of the defect, the value the item would have without the defect, and whether the defect can be removed by the other method. The seller may refuse to remove the defect if this is impossible or disproportionately expensive, in particular with regard to the significance of the defect and the value the item would have without the defect.

7.6. The seller will remove the defect within a reasonable time after it has been reported, so as not to cause the buyer significant inconvenience, taking into account the nature of the item and the purpose for which the buyer bought it. To remove the defect, the seller will take over the item at its own expense. If this requires dismantling an item that was installed in accordance with its nature and purpose before the defect appeared, the seller will dismantle the defective item and install the repaired or new item, or reimburse the associated costs.

7.7. The buyer may demand a reasonable discount or withdraw from the purchase contract if:
7.7.1. the seller has refused to remove the defect or has not removed it in accordance with Article 7.5,
7.7.2. the defect appears repeatedly,
7.7.3. the defect is a material breach of the purchase contract, or
7.7.4. it is clear from the seller's statement or from the circumstances that the defect will not be removed within a reasonable time or without significant inconvenience to the buyer.

7.8. If the defect is insignificant, the buyer cannot withdraw from the purchase contract (within the meaning of Article 7.7); a defect is presumed not to be insignificant.

7.9. If the buyer withdraws from the purchase contract, the seller will refund the purchase price to the buyer without undue delay after receiving the item or after the buyer proves that the item has been sent.

7.10. A defect may be reported to the seller from whom the item was purchased. However, if another person is designated to carry out repairs at the seller's location or at a location closer to the buyer, the buyer reports the defect to the person designated to carry out the repair.

7.11. Except where another person is designated to carry out the repair, the seller is obliged to accept a complaint at any establishment where this is possible with regard to the range of products sold or services provided, or at its registered office. When a complaint is lodged, the seller is obliged to issue the buyer with a written confirmation stating the date on which the complaint was lodged, its content, the method of handling the complaint requested by the buyer and the buyer's contact details for the purpose of providing information on the outcome of the complaint. This obligation also applies to other persons designated to carry out repairs.

7.12. The complaint, including removal of the defect, must be handled and the buyer informed at the latest within thirty (30) days of the date on which the complaint was lodged, unless the seller and the buyer agree on a longer period. If the subject of the obligation is the supply of digital content, including digital content supplied on a tangible medium, or a digital content service, the complaint must be handled within a reasonable time, taking into account the nature of the digital content or service and the purpose for which the buyer requested it.

7.13. If the period under Article 7.12 expires without result, the buyer may withdraw from the purchase contract or demand a reasonable discount.

7.14. The seller is obliged to issue the buyer with a confirmation of the date and method of handling the complaint, including confirmation of the repair and its duration, or a written justification for rejecting the complaint. This obligation also applies to other persons designated to carry out repairs.

7.15. The buyer may exercise rights arising from liability for defects of goods in particular by e-mail at treasuresprague@gmail.com.

7.16. A person entitled to rights arising from defective performance is also entitled to reimbursement of costs reasonably incurred in exercising this right. However, if the buyer does not claim reimbursement within one month after the expiry of the period within which the defect must be reported, the court will not grant the right if the seller objects that the right to reimbursement was not exercised in time.

7.17. Further rights and obligations of the parties relating to the seller's liability for defects may be governed by the seller's complaints procedure.

8. OTHER RIGHTS AND OBLIGATIONS OF THE CONTRACTING PARTIES

8.1. The buyer acquires ownership of the goods upon payment of the full purchase price.

8.2. In relation to the buyer, the seller is not bound by any codes of conduct within the meaning of Section 1820(1)(n) of the Civil Code.

8.3. The seller handles consumer complaints by e-mail. Complaints can be sent to the seller's e-mail address. The seller will send information on the handling of the buyer's complaint to the buyer's e-mail address. The seller has not established any other rules for handling complaints.

8.4. The Czech Trade Inspection Authority, with its registered office at Gorazdova 1969/24, 120 00 Prague 2, Company ID: 000 20 869, website: https://adr.coi.cz/en, is competent for the out-of-court resolution of consumer disputes arising from the purchase contract. The European Online Dispute Resolution (ODR) platform was discontinued as of 20 July 2025 on the basis of Regulation (EU) 2024/3228 of the European Parliament and of the Council, which repealed Regulation (EU) No 524/2013. An overview of the bodies competent for the out-of-court resolution of consumer disputes in the individual EU member states is available at https://consumer-redress.ec.europa.eu/dispute-resolution-bodies_en.

8.5. The European Consumer Centre Czech Republic, with its registered office at Gorazdova 1969/24, 120 00 Prague 2, website: https://evropskyspotrebitel.gov.cz, provides consumers with free advice and assistance in cross-border disputes with foreign sellers within the EU.

8.6. The buyer may file a complaint with a supervisory or state supervision authority. The seller is authorised to sell goods on the basis of a trade licence. Trade inspection is carried out within its competence by the relevant trade licensing office. Supervision of personal data protection is carried out by the Office for Personal Data Protection. The Czech Trade Inspection Authority supervises, to a defined extent, compliance with the Civil Code and Act No. 634/1992 Coll., on Consumer Protection, as amended, among other things.

8.7. The buyer hereby assumes the risk of a change in circumstances within the meaning of Section 1765(2) of the Civil Code.

9. PERSONAL DATA PROTECTION

9.1. The seller fulfils its information obligation towards the buyer within the meaning of Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter the "GDPR"), relating to the processing of the buyer's personal data for the purposes of performing the purchase contract, negotiating the purchase contract and fulfilling the seller's public-law obligations, by means of a separate document.

10. SENDING COMMERCIAL COMMUNICATIONS AND STORING COOKIES

10.1. Within the meaning of Section 7(2) of Act No. 480/2004 Coll., on Certain Information Society Services and on Amendments to Certain Acts, as amended, the buyer agrees to receive commercial communications from the seller at the buyer's e-mail address or telephone number. The seller fulfils its information obligation towards the buyer within the meaning of Article 13 GDPR relating to the processing of the buyer's personal data for the purpose of sending commercial communications by means of a separate document.

10.2. The seller fulfils its legal obligations relating to any storage of cookies on the buyer's device by means of a separate document.

11. DELIVERY OF DOCUMENTS

11.1. Documents may be delivered to the buyer at the buyer's e-mail address.

12. FINAL PROVISIONS

12.1. If the relationship established by the purchase contract contains an international (foreign) element, the parties agree that the relationship is governed by Czech law. This choice of law does not deprive a buyer who is a consumer of the protection afforded by provisions of law that cannot be derogated from by agreement and that would otherwise apply in the absence of a choice of law under Article 6(1) of Regulation (EC) No 593/2008 of the European Parliament and of the Council of 17 June 2008 on the law applicable to contractual obligations (Rome I).

12.2. If any provision of these terms of service is or becomes invalid or ineffective, it will be replaced by a provision whose meaning comes as close as possible to the invalid provision. The invalidity or ineffectiveness of one provision does not affect the validity of the other provisions.

12.3. The purchase contract, including the terms of service, is archived by the seller in electronic form and is not accessible.
